1. Agreement to Terms
By accessing or using the Displaced website and services operated by Custora Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you may not access our services.
2. Description of Services
Displaced provides AI-powered pet portrait generation services. Users can upload photographs of their pets and receive AI-generated artistic portraits in various styles. We offer both digital downloads and physical print products.
3. User Accounts
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Intellectual Property
Your Content: You retain ownership of any photographs you upload. By uploading content, you grant us a limited license to process your images for the purpose of generating portraits.
Generated Content: Upon purchase, you receive a personal, non-exclusive license to use the generated portrait for personal, non-commercial purposes. Commercial use requires a separate license.
Our Content: All other content on the website, including but not limited to text, graphics, logos, and software, is the property of Custora Inc. and is protected by intellectual property laws.
5. Acceptable Use
You agree not to:
- Upload content that you do not have the right to share
- Upload content that is illegal, harmful, or offensive
- Attempt to reverse engineer or extract our AI models
- Use our services for any unlawful purpose
- Interfere with or disrupt the integrity of our services
6. Payments and Pricing
All prices are displayed in USD unless otherwise stated. We reserve the right to change our prices at any time. Payment processing is handled securely through Stripe. By making a purchase, you agree to Stripe's terms of service.
7. Digital Products
Digital products are delivered electronically and are available for download immediately upon purchase. Due to the nature of digital products, all sales of digital downloads are final.
8. Physical Products
Physical prints are produced and shipped by our fulfillment partners. Shipping times vary by location. Please refer to our Shipping & Returns policy for detailed information.
9. Limitation of Liability
To the fullest extent permitted by law, Custora Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.
10. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our AI will produce results that meet your expectations in every instance.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of British Columbia.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new terms.
